By using the Website you confirm that you are at least 18 years old, or, if you are under 18, that you are accessing the Website with the consent of your parent of guardian.
In the case of registered users, we reserve the right to terminate access in the event of unauthorised access or use of an account, or breach (in our opinion) of the User Terms.

Price of the Goods
The prices of the products you order are to be those prices as displayed at the moment of transmission of your order.
Where appropriate all prices will be displayed in pounds Sterling. This is subject to alteration, when enforced, without notice. Please refer to individual prices.
Postal charges are added to the prices of the products ordered prior to transaction completion.

Representation and Specification of Goods
Some items may appear slightly larger or smaller than actual size due to screen defaults and photography techniques. Other items may be represented at a larger than actual size in order to clearly show details, or smaller than actual size in order to show the entire item.
Due to the limitations of colour display your screen may not show exactly the correct colour of the product being viewed.
Your attention is drawn to the item description where specific product details are given. This information is given in good faith but total accuracy cannot be guaranteed.
All products are offered subject to availability.

Terms of payment
If you wish to pay for your selection by credit/debit card, you will be charged for your selection of goods at the time of placing your order. However products will not be dispatched to you until payment has been confirmed as valid and lawful and made in full.

Delivery
Most items will be dispatched within 5 working days. As stock levels vary by season, in extreme circumstances please allow up to 28 days for dispatch. If your order is urgent and required for a specific date, please contact us.
For the avoidance of doubt, time shall not be of the essence in respect of delivery of your purchases.
We shall be under no liability for any delay in delivery or non-delivery due to circumstances beyond our control.
If the parcel / product is lost or found to be damaged upon receipt then Royal Mail and Plush Jewellery Ltd must be informed without delay and any damaged item(s) returned to us for replacement.

Insurance
Plush Jewellery Ltd provides product insurance to items whilst in transit delivery only up to the point of customer’s signed receipt.
It is the customer’s responsibility for appropriate insurance cover thereafter.

Any special offers by Plush Jewellery Ltd from time to time are made strictly on the following conditions:

Liability
Plush Jewellery Ltd gives no warranty or representation as to the accuracy, suitability or reliability of the information or content of the Website for any purpose. Subject to the following provisions Plush Jewellery Ltd warrants that any products supplied will correspond with any applicable specification at the time of delivery and will be free from defects in material and workmanship for a period of twelve months from delivery. This warranty is given subject to the following conditions:
(a) Plush Jewellery Ltd shall be under no liability in respect of any defect in the products arising from any specification or instructions by you or errors or inadequacies in the same;
(b) Plush Jewellery Ltd shall be under no liability in respect of any defect arising from fair wear and tear, wilful damage or alteration or repair of products without our approval;
(c) the above warranty does not extend to products not manufactured by Plush Jewellery Ltd in respect of which you will only be entitled to the benefit of any such warranty or guarantee as is given by the manufacturer to Plush Jewellery Ltd.
Subject as expressly provided in these Terms and Conditions, and except where products are sold to a person dealing as a consumer (within the meaning of the Unfair Contract Terms Act 1977), all warranties, conditions or other terms implied by statute or common law are excluded to the fullest extent permitted by law in respect of any products supplied by Plush Jewellery Ltd.
Where we have replaced defective products or products failing to meet specification, or refunded to you the price of such products (or a proportionate part of the price), Plush Jewellery Ltd shall have no further liability to you.
Except in respect of death or personal injury caused by our negligence, or liability for defective products under the Consumer Protection Act 1987, Plush Jewellery Ltd shall not be liable to you by reason of any representation (unless fraudulent), or any implied warranty, condition or other term, or any duty at common law or under these Terms and Conditions for loss of profit or for any indirect, special or consequential loss or damage, costs, expenses or other claims for compensation whatsoever (whether caused by the negligence of Plush Jewellery Ltd, its employees or agents or otherwise) which arise out of or in connection with the supply of products (including any delay in supplying or any failure to supply products in accordance with these Terms and Conditions or at all) or their use or re-sale by you and the entire liability of Plush Jewellery Ltd under or in connection with the supply of products shall not exceed the price of the products.
Plush Jewellery Ltd shall not be liable to you by reason of any delay in performing, or any failure to perform, any of its obligations in relation to the products, if the delay or failure was due to any cause beyond our reasonable control.

Jurisdiction, Entire Agreement and Severability
Every purchase you make shall be deemed performed in England. English law shall govern these Terms and conditions and every aspect of contractual agreement concerning purchases made from us and Plush Jewellery Ltd and the customer submit to the non-exclusive jurisdiction of the English Courts.
These Terms and Conditions and Privacy Policy contain the entire agreement between you and Plush Jewellery Ltd relating to your purchase and supersede all previous agreements and understandings between us.
The invalidity or enforceability of any term shall not affect the validity or enforceability of any of the other terms. If any provision of these Terms and Conditions is or becomes invalid or contravenes any applicable law in whole or in part, the offending provision or part thereof shall be severed and the remaining provisions and the remainder of the affected provision shall remain in full force and effect.

Legal
All products sold by Plush Jewellery Ltd shall remain the property of Plush Jewellery Ltd until payment of the total product invoice amount.
You undertake that all details you provide us for the purpose of ordering or purchasing products (including any applicable specification) are correct, that the credit or debit card you are using for the purpose of ordering or purchasing products is your own and that there are sufficient funds to cover the cost of the product or service being purchased.
If there are any changes to the details supplied to us by you it is your responsibility to inform Plush Jewellery Ltd within a reasonable period after supply of such details. We shall have no liability to you arising from your failure to do this.
Confirmation of receipt of your order by e-mail, does not guarantee the product sale.
For credit card purchases your account will be charged for the products selected with the prices displayed at the moment of your order acceptance. For all other methods of payment orders will commence manufacture process on credit clearance confirmation.
Plush Jewellery Ltd reserves the right to add to, delete from, and modify these Terms and Conditions at any time without any prior notice. Please visit these Terms and Conditions prior to purchasing each order.

Nothing in these User Terms shall be construed as constituting a legal partnership or joint venture between you and us.
